BREEDING CONTRACT
Rimrock Livestock


I hereby agree that I will breed my mare,_______________________________, registration number_________,to the stallion, Playboys Phoenix, for the 20____ breeding season, which begins March 1 and ends July 1, subject to the following terms and conditions.

1.     The Stallion fee is $1,000.00 including a non-refundable 30% booking fee.  The chute fee of $350.00 is included if the booking fee is paid before March 1, 2007, otherwise it is additional. The chute fee includes collection and breeding/regular shipping. The chute fee will be charged with each additional shipment of semen and must be paid prior to shipment. Credit card payments require an additional charge of 2-4% depending on the card used. Any remaining balance must be paid in full one week prior to breeding or shipping of semen. For on site breeding, all other expenses, including board and additional veterinary treatments shall be paid in full before the mare is released. 

2.     Harlowton Veterinary Clinic agrees to provide board for the care and feed of the mare and/or foal while in their custody at $10.00/day(dry) and $15.00/day(wet). 

3.     Harlowton Veterinary Clinic will examine mare for normal breeding conditions and will administer medical care as deemed necessary for the health and the safety of the mare and/or foal.  Mare owner hereby consents to all medical care administered to the mare by the veterinarian.  Mare owner, as provided in paragraph 1, will pay all veterinarian and farrier expenses. 

4.     The mare shall be in a healthy and sound breeding condition, free from infections, contagious or transmissible disease.  A current negative Coggins Test, photo static copy of registration papers (both sides), veterinarian’s health certificate, plus a health, worming, and immunization record must accompany mare: if mare owner should fail to provide any of the above documents, Mare Owner hereby consents to Harlowton Veterinary Clinic examining and/or testing the mare as may be necessary to complete the above tests, certification and other records, all to be completed at mare owner’s expense.  HOWEVER, Harlowton Veterinary or Rimrock Livestock reserves the right to refuse to accept any mare which is (1) not in proper condition or (2) which does not have all of the records, tests, and registration documents required herein. 

5.     Breeder agrees to diligently try to settle Owner’s mare. Mare owner agrees to give Breeder ample opportunity to settle the mare (having bred her through at least two (2) heat-periods.  IF THE MARE LEAVES BEFORE PREGNANCY CHECKED, THE LIVE FOAL GUARANTEE THEN BECOMES VOID. If, however, for any reason the mare does not settle, mare owner will hold Harlowton Veterinary Clinic and Rimrock Livestock harmless. 

6.     This contract contains a “Live Foal Guarantee”. A live foal is described as a newborn foal, which stands and nurses unassisted. If the foal is born dead, return privileges shall apply only if Rimrock Livestock is notified within seven (7) days thereof and receives a veterinarian’s statement confirming death.  Breeder makes no warranty as to the quality or conformation of the foal. The live foal guarantee in this contract is non-transferable and should the mare be sold or otherwise disposed of prior to the birth of the foal, the live foal guarantee granted, shall be void. Return privileges shall apply only to the next normal breeding season.

7.     If the mare miscarries, proves barren after being pregnancy checked in foal, or fails to conceive during the normal breeding season, Breeder agrees to breed said mare again during the immediately following year’s breeding season.  There will be a charge of $450.00 for the “re-breed” service expenses. Should the original mare be deemed unfit for breeding, a substitute mare may be accepted at the discretion of Rimrock Livestock.

8.     A “Breeder’s Certificate” will be issued for the foal conceived by the mating when stallion fees and all other expenses have been paid in full.  Mare Owner will receive a “Breeder’s Certificate” when Rimrock Livestock has been notified that a live foal has been produced.

9.     Neither Rimrock Livestock and/or Harlowton Veterinary Clinic nor anyone associated with these two parties shall be liable for the death, sickness, and/or accident to the Mare and/or foal; similarly, neither the Mare Owner nor any other person associated with the mare shall be liable for the death, sickness, and/or accident to the stallion.

10.   The parties further agree that should the stallion die or become unfit for service for any reason or if the mare should die or become unfit to breed during the 2004 breeding season, then this contract shall be come null and void and both parties are relieved of any further obligation hereunder.  Likewise any monies heretofore paid by the mare owner toward the stallion fee, with the exception of the non-refundable booking free, shall be refunded to mare owner. However, mare owner shall pay for the other expenses actually incurred.

11.   This contract shall be binding upon the parties hereto, upon execution hereof and the same may not be altered or amended, except by written mutual consent of the parties hereto.
